These Terms and Conditions govern access to and use of the website www.portodimaratea.it (the “Site”) and the mooring and nautical assistance services provided by Evolvia Services S.r.l. (the “Company”).

1. Company Identity and Institutional Independence

The Site is exclusively owned and managed by Evolvia Services S.r.l., with registered office in Maratea (PZ), Via Racia snc, VAT 02205910769. Transparency Note: The Company operates under a private maritime concession for the management of recreational boating services and moorings. Specifically:

• Evolvia Services S.r.l. is an independent private entity not affiliated with, controlled by, or participating with the Municipality of Maratea or any other local public authorities.

• The Site serves purely commercial and informational purposes for boaters and does not constitute an institutional portal of the Public Administration.

• The domains portodimaratea.it and portodimaratea.com are used to promote the services offered by the Company within the scope of its concession.

2. Scope of Services

The booking and information services on the Site apply exclusively to the 90 berths and related infrastructure managed by Evolvia Services S.r.l. within the Maratea port area. The Company is not responsible for other areas or docks outside its operational control.

3. Use of the Site and Intellectual Property

3.1 Ownership of Trademarks: The denomination and figurative trademark "Porto di Maratea – Yacht Marina", its logo, payoffs, and all other distinctive signs on the Site are the exclusive property of Evolvia Services S.r.l. (or licensed to it). The trademark is registered with the Italian Patent and Trademark Office (UIBM) and protected under Legislative Decree 30/2005 (Industrial Property Code).

3.2 Domains and Digital Identity: The Company exclusively owns the domains www.portodimaratea.it and www.portodimaratea.com. Registration of similar domains (typosquatting) or use of the trademarks as meta-tags, keywords, or in advertisements (e.g., Google Ads) by unauthorized third parties is prohibited if it may cause public confusion.

3.3 Prohibited Use: Reproduction, imitation, extraction, or use, even partial, of the trademark and logo without prior written consent is forbidden. Any unauthorized use that may suggest affiliation, sponsorship, or connection with third parties (including other port operators or public authorities) will be prosecuted under applicable law.

3.4 Copyright on Content: All texts (including the narrative description of the port and territory), photographs, graphics, and site layout are protected under copyright law (Law 633/1941). Systematic copying or web scraping for commercial purposes or to create competing databases is prohibited.

4. Bookings and Payments

Booking requests submitted through the Site are subject to written confirmation by the Company. Acceptance of a berth implies compliance with Ordinance 44/2018 and current safety regulations. The Company reserves the right to request documentation of the vessel and the mandatory liability insurance policy before access to the dock.

5. Limitation of Liability

Evolvia Services S.r.l. is not liable for service interruptions caused by force majeure, adverse weather or sea conditions, or decisions by Maritime and Municipal Authorities that may limit access to the port or docks.

6. Privacy and Data Protection

The processing of personal data provided by users through the Site is carried out in full compliance with EU Regulation 2016/679 (GDPR), as detailed in our [Privacy Policy].

7. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any disputes concerning interpretation or enforcement of this agreement shall fall exclusively under the jurisdiction of the Court of Lagonegro (PZ). Reports of violations of industrial property rights can be sent to: info@portodimaratea.it
